When working with matching programs, surrogacy agencies or any other third-party reproduction services, Intended Parents and Gestational Carriers and Donors may enter into contracts or agreements that will need to be reviewed for accuracy, fairness, and appropriateness.

Consent documents with the IVF center
Disposition of egg, sperm, or embryo documents
Agency engagement documents
“Benefit” documents for donors, gestational surrogates, and sometimes intended parents*
*Gestational carriers (and often intended parents) will be asked to sign or review documents from the matching agency or program. These documents detail the anticipated fees and expenses that will become part of the legal agreement between the parties later on. Commonly, the parties are not aware of the significance of signing a “benefits” document. Before you sign anything, know your rights and obligations, and understand what you are agreeing to by having a careful review with your attorney. You should always have a review of every document with your attorney before signing — each document you sign is a legal one and may be relied on later on.
